Terms and Conditions for Riev Property Management
Welcome to Riev Property Management. These Terms and Conditions (“Terms”) govern your use of our property management and cleaning services. By engaging with Riev Property Management for any of our services, you agree to be bound by these Terms. Please read them carefully.
1. Services Offered
Riev Property Management provides comprehensive property management services for residential and commercial properties, including but not limited to:
- Property Evaluation and Rental Rate Determination: Detailed documentation, recommendations for improvements, and optimal rental rate setting.
- Property Marketing for Rent: Home preparation, tailored advertising, collaboration with realtors, 24-hour hotline, prospect engagement, property showings, and application processing.
- Tenant Screening and Selection: Background checks, tenant grading, and applicant notification.
- Tenant Move-In: Lease agreement drafting, move-in date confirmation, lease guideline review, agreement execution, detailed move-in inspections, and initial payment collection.
- Rent Collection: Receiving rent, managing late payments, sending notices, and enforcing late fees.
- Evictions: Filing paperwork, court representation, and coordination with law enforcement.
- Legal Support: Advising on legal disputes, attorney referrals, and ensuring compliance with local legislation.
- Property Inspections: Periodic inspections for repair needs, safety hazards, code violations, lease violations, and owner reporting.
- Financial Management: Accounting services, payments on behalf of the owner, detailed expense documentation, historical record keeping, and annual tax reporting.
- Maintenance, Repairs, and Remodeling: In-house maintenance, preventative maintenance policies, network of vetted contractors, job assignment, outdoor area maintenance, 24-hour emergency hotline, and renovation project management.
- Residential and Commercial Cleaning Services:
- Air Ducts & HVAC Cleaning
- Biohazard Cleanup
- Carpet & Upholstery Cleaning
- Ceiling, Floors & Walls Cleaning
- Drapes & Blinds Cleaning
- Odor Removal
- Sewage & Toilet Overflow Cleanup
- Trauma & Crime Scene Cleanup
- Vandalism & Graffiti Removal
- Tenant Move-Out: Unit inspection, damage assessment, security deposit handling, cleaning, repairs/upgrades, lock changes, and re-marketing.
Specific details regarding the scope, duration, and fees for any service will be outlined in a separate Service Agreement or contract between Riev Property Management and the client.
2. Client Responsibilities
Clients engaging Riev Property Management services agree to:
- Provide accurate and complete information regarding the property and any relevant details.
- Grant necessary access to the property for inspections, showings, maintenance, and cleaning services.
- Approve repair limits and significant expenditures as outlined in the Service Agreement.
- Adhere to the payment terms for services rendered as specified in the Service Agreement.
- Provide Riev Property Management with all necessary documentation and information required for effective management and compliance.
3. Riev Property Management Responsibilities
Riev Property Management commits to:
- Act in the best interest of the client within the scope of the Service Agreement.
- Exercise due diligence and professional care in the performance of all services.
- Maintain accurate records and provide transparent financial reporting.
- Comply with all applicable laws and regulations in Rungiri, Kiambu County, Kenya, and relevant national laws.
- Protect the confidentiality of client information as per our Privacy Policy.
4. Fees and Payments
Fees for services will be detailed in the individual Service Agreement or cleaning service quotation. Payment terms, including due dates, accepted payment methods, and consequences of late payments, will be clearly specified in the respective agreement. All fees are quoted in Kenya Shillings (KES) unless otherwise stated.
5. Limitation of Liability
Riev Property Management will not be liable for any loss, damage, or expense arising from:
- Force Majeure events, including but not limited to acts of God, war, terrorism, natural disasters, or government actions beyond our reasonable control.
- Pre-existing conditions of the property not disclosed by the client.
- Actions or omissions of third parties not under our direct control.
- Any claims exceeding the specific service fees paid to Riev Property Management for the period during which the incident occurred.
Our liability for any direct damages arising from our negligence or breach of contract shall be limited to the total management fees paid by the client to Riev Property Management over the preceding six (6) months, or as otherwise specified in the Service Agreement.
6. Indemnification
The client agrees to indemnify and hold harmless Riev Property Management, its employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in connection with:
- Any breach by the client of these Terms or the Service Agreement.
- Any misrepresentation or inaccuracy in information provided by the client.
- Any injury or damage to persons or property occurring on the client’s property, unless directly caused by the gross negligence or willful misconduct of Riev Property Management.
7. Confidentiality
All information shared between the client and Riev Property Management regarding the property, financials, and personal details will be treated as confidential and will not be disclosed to third parties without prior consent, except where required by law or necessary for the provision of services (e.g., sharing tenant information with contractors for repairs).
8. Termination of Services
Either party may terminate the Service Agreement in accordance with the terms specified therein. Typically, a notice period will be required for termination. Upon termination, the client will be responsible for all fees accrued up to the termination date.
9. Governing Law and Dispute Resolution
These Terms and any Service Agreement shall be governed by and construed in accordance with the laws of Kenya.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service Agreement, including the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through good faith negotiations between the parties. If an amicable resolution cannot be reached, the dispute shall be referred to mediation. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kenya, located in Kiambu County.
10. Amendments to Terms
Riev Property Management reserves the right to update or modify these Terms at any time. Any changes will be posted on our website with an updated “Effective Date.” Continued engagement with our services after such modifications constitutes your acceptance of the revised Terms.
